Part II of the Housing Grants, Construction and Regeneration Act 1996 (Construction Act 1996) includes statutory rules on adjudication and payment under construction contracts. This House of Lords' decision considers payments under the Construction Act 1996 in the context of a contractor's insolvency.
The House of Lords gave a three to two majority decision and the detail of the majority judgments varies. The case concerns a Scottish building contract under Scottish law, but the Construction Act 1996 applies to England, Wales and Scotland.
