Contract in writing and adjudicator properly appointed

by PLC Construction
In Sprunt Ltd v London Borough of Camden [2011] EWHC 3191 (TCC), Akenhead J enforced the adjudicator's decision. The Technology and Construction Court (TCC) held that there was an agreement in writing. Also, as the adjudication provisions in Part I of the Scheme for Construction Contracts (England and Wales) Regulations 1998 (SI 1998/649) (Scheme for Construction Contracts 1998), were implied into the contract, there was no specified nominating body and the consultant was free to approach the RICS for an adjudicator appointment.
