Edwards-Stuart J in the Technology and Construction Court (TCC) has held in Berry Piling Systems Ltd v Sheer Projects Ltd [2012] EWHC 241 (TCC) that the adjudicator did not breach the rules of natural justice. The court refused to grant a stay of execution of the judgment sum due to the sub-contractor's (Berry) financial position.
