In Nulty and others v Milton Keynes Borough Council [2013] EWCA Civ 15, the Court of Appeal dismissed an appeal against the Technology and Construction Court's (TCC) ruling that a series of fires that damaged a recycling plant were caused by a cigarette discarded by a self-employed engineer.
