We have updated our Standard document, Professional consultant's letter of appointment to include integrated building information modelling (BIM) provisions, meaning that users avoid many of the difficulties associated with incorporating a separate BIM protocol. (Free access.)
We have reviewed and updated our Standard document, Professional consultant's letter of appointment, to include integrated building information modelling (BIM) provisions.
The integrated provisions:
  • Allow parties to include BIM provisions within the terms and conditions of their appointment, rather than appending them as a schedule using a BIM protocol. This simplifies the appointment, makes it easier to understand and removes many potential difficulties that arise when using a BIM protocol (for example, the need to incorporate the BIM protocol or include a priority of documents clause).
  • Appear as optional clauses, so the professional appointment can still be used on a project that is not BIM-enabled.
  • Are accompanied by drafting notes explaining their use and any negotiating points.
Our Standard document, Professional appointment already includes integrated BIM provisions and we will be adding further BIM functionality to our JCT schedules of amendments shortly. We will also add to our BIM material next week, with a podcast featuring Stuart Pemble of Mills & Reeve LLP.
