In Thameside Construction Company Ltd v Stevens and another [2013] EWHC 2071 (TCC), Akenhead J in the Technology and Construction Court (TCC) held that the employer under a building contract could not set off liquidated damages (LDs) against a sum due to the contractor under an adjudicator's decision.
