In Epping Electrical (see links below), Judge Richard Havery QC held that the CIC Adjudication Procedure did not comply with the Housing Grants, Construction and Regeneration Act 1996 (HGRCA). It followed that the Scheme for Construction Contracts (SI 1998/649) (the Scheme) applied to the contract between the parties.
In a judgment dated 1 February 2007 in Aveat Heating Limited v Jerram Falkus Construction Limited [2007] EWHC 131 (TCC), the same judge ruled that the standard form of GC/Works sub contract (and, by extension, the GC/Works main contract) did not comply with the HGRCA. The Scheme's adjudication rules applied.
