In Oceanbulk Shipping & Trading SA v TMT Asia Ltd [2010] EWCA Civ 79, the Court of Appeal considered whether without prejudice discussions were admissible as an aid to construction.
This decision was appealed to the Supreme Court, who allowed the appeal (Oceanbulk Shipping & Trading SA v TMT Asia Ltd and other [2010] UKSC 44) - see Legal update, Supreme Court recognises new exception to the without prejudice rule: the "interpretation exception".
