Effective use of Part 8 in adjudication proceedings

Akenhead J's judgment in PC Harrington Contractors Ltd v Tyroddy Construction Ltd [2011] EWHC 813 (TCC) demonstrates effective use of CPR Part 8 in adjudication proceedings when the parties disagree over the terms of their contract and the adjudicator's decision.
In a related subsequent judgment, in PC Harrington Contractors Ltd v Systech International Ltd [2012] EWCA Civ 1371, the Court of Appeal held that the adjudicator was not entitled to his fees because his decision was unenforceable due to a breach of the rules of natural justice.
