Third party's liability for contribution after settlement

by PLC Construction
In Mouchel Ltd v Van Oord (UK) Ltd [2011] EWHC 72, the Technology and Construction Court (TCC) held a third party sub-contractor liable for the same damage as a professional consultant, in relation to the defects in the offshore elements of a power station's cooling system. The TCC considered the meaning of the "same damage" and the "just and equitable" contribution under the Civil Liability (Contribution) Act 1978.
NOTE 29.6.11: The High Court has considered a related application in this case. PLC's coverage of this judgment can be found here.
