TCC rejects claim for damages following fire at aggregate processing plant

In United Marine Aggregates Ltd v GM Welding and Engineering Ltd and another [2012] EWHC 779 (TCC), Edwards-Stuart J held that the defendant was not liable for a fire caused by hot work it carried out at the claimant's aggregate processing plant.
The court also found, obiter, that the defendant would not have been able to rely on its public liability insurance because it had failed to follow the insurer's requirements for safeguards during hot working.
Note added (15.05.2013): Edwards-Stuart J's ruling was unanimously upheld on appeal (see Legal update, Claim for damages following fire at aggregate processing plant (Court of Appeal)).
