In Brit Inns Ltd and another v BDW Trading Ltd (No 2) [2012] EWHC 2489 (TCC), the High Court considered the proper approach to costs in a case where the defendant had taken a more realistic view of the value of the claim than the claimants throughout, but failed to protect their position on costs by making an appropriate Part 36 offer.
