An update on Land Securities plc and others v Fladgate Fielder [2009] EWHC 577 (Ch), which considered whether an application for judicial review of a planning permission application constituted the tort of abuse of process.
NB. On 18 December 2009, the Court of Appeal dismissed the claimants' appeal in Land Securities PLC and others v Fladgate Fielder (a firm)[2009] EWCA Civ 1402. In so doing, it ran through the arguments and authorities on the scope of the tort of abuse and held that the tort should not be extended to economic loss of the kind in issue.
