FAQs on Construction Act 1996 changes updated

Practice notes, LDEDC Act 2009: FAQs on payment and LDEDC Act 2009: FAQs on adjudication, have been updated following subscriber feedback about what happens if some project contracts are entered into before and some after the effective date of the amendments to the Housing Grants, Construction and Regeneration Act 1996 (Construction Act 1996).
Following subscriber feedback about what happens if some project contracts are entered into before and some after the effective date of the amendments to the Housing Grants, Construction and Regeneration Act 1996 (Construction Act 1996), as amended by Part 8 of the Local Democracy, Economic Development and Construction Act 2009 (LDEDC Act 2009), we have updated Practice notes, LDEDC Act 2009: FAQs on payment and LDEDC Act 2009: FAQs on adjudication.
Both notes now include a section explaining that:
  • It is the date of the particular contract that is important, not the date of other contracts on the project, including the main contract.
  • Two different sets of payment, suspension and adjudication provisions are likely to apply on projects that span the effective date.
