In Walter Lilly & Company Ltd v Giles Patrick Cyril Mackay and another [2012] EWHC 1773 (TCC), Akenhead J in the Technology and Construction Court, ruled against an employer on most issues in connection with the contractor's claims relating to causation, extension of time, defects and an alleged global claim for loss and expense (including delay and disruption and head office overheads and profit).
On 24 January 2013, permission to appeal was refused by the Court of Appeal, see Walter Lilly & Company Limited v Mackay and another [2013] EWCA Civ 142.
