Disclosure: the key reforms coming into force in April 2013

by Practical Law Dispute Resolution
This article focuses on the changes to the disclosure rules in CPR 31, being brought in by the Civil Procedure (Amendment) Rules 2013, which implement Lord Justice Jackson's recommendations for reform, and which will come into force on 1 April 2013.
Practical Law Dispute Resolution is grateful for the comments provided by the Senior Master, Master Whitaker, Vince Neicho of Allen & Overy LLP, and Michael Mendelblat of Herbert Smith Freehills LLP.
Note that all of our maintained content is being reviewed and amended as necessary to reflect the changes. On or before 1 April 2013 (when the majority of the reforms take effect), our maintained materials will have been revised and updated to take account of the new regime and transitional provisions.
Note: On 20 March 2013, after this article was published, the Ministry of Justice finally published the new and revised court forms to be used from 1 April 2013 (subject to the relevant transitional provisions). Unexpectedly, these included Form N263, which appears to be a standard template form of Disclosure Report. As this is not referred to in the rules or practice directions, in our view it is not a prescribed form, but practitioners are advised to consider it at least.
