Pre-adjudication contact with an adjudicator should be in writing

Makers UK Limited v The Mayor and Burgesses of the London Borough of Camden [2008] EWHC 1836 (TCC).
In a claim to enforce an adjudicator's decision, Mr Justice Akenhead rejected challenges on the grounds that:
  • There was an implied term in the building contract that parties would not seek to influence a nominating body's choice of adjudicator.
  • There was apparent bias arising out of a telephone call made before the adjudicator's appointment.
  • The adjudicator was improperly appointed and had no jurisdiction.
