Court of Appeal calls for more guidance on the correct approach to costs management

In Troy Foods Ltd v Manton [2013] EWCA Civ 615, the Court of Appeal considered an application for leave to appeal made on the basis that the judge below had adopted the wrong approach when considering the parties' budgets in the context of the costs management pilot scheme in the TCC and mercantile courts. Although the decision relates to the pilot scheme under PD 51G, the judges' comments apply to costs management generally.
Note: Although leave to appeal was granted, the parties have since settled the case.
