In Linklaters Business Services v McAlpine Ltd and others [2010] EWHC 2931 (TCC), Akenhead J held that both the contractor and the sub-contractor were in breach of contract. However, the sub-sub-contractor did not breach its duty of care in tort to either the sub-contractor or the employer.
