In CN Associates (A Firm) v Holbeton Ltd [2011] EWHC 43 (TCC), the claimant's summary judgment application in adjudication enforcement proceedings was refused. Akenhead J gave the defendant conditional leave to defend, pending payment into court of the full amount claimed.
