In Whyte and Mackay Ltd v Blyth & Blyth Consulting Engineers Ltd [2012] ScotCS CSOH 89, the defender (the responding party) was permitted to lodge a counterclaim not related to enforcement issues, even though the pursuer (the referring party) argued that would delay adjudication enforcement proceedings.
