In Morris Homes (West Midlands) Ltd v Keay and another [2013] EWHC 932 (TCC), HHJ David Grant in the Technology and Construction Court distinguished an obligation to carry out the works with due diligence from an obligation to use all reasonable endeavours to ensure that the works were completed as soon as reasonably practicable.
